Terms and Conditions – Malundo
1. Definitions
In these terms and conditions, the following definitions apply:

Malundo: the business operating the webshop.

Customer: any natural or legal person placing an order with Malundo.

Agreement: the agreement between Malundo and the customer regarding the purchase of products through the webshop.
2. Applicability
These terms and conditions apply to all offers, orders, and agreements between Malundo and the customer, unless expressly agreed otherwise in writing.
3. Offer and Agreement
3.1 All offers made by Malundo are non-binding.
3.2 The agreement is established when the customer places an order and Malundo confirms this order in writing (via email).
4. Prices and Payment
4.1 All prices are in euros and include VAT, unless stated otherwise.
4.2 Payment must be made using one of the available payment methods at the time of ordering.
4.3 Malundo reserves the right to change prices at any time.
5. Delivery
5.1 Delivery will take place at the address provided by the customer within the indicated delivery time.
5.2 Malundo is not liable for delays beyond its control.
5.3 The risk of the products transfers to the customer at the time of delivery.
6. Right of Withdrawal
6.1 The customer has the right to withdraw from the purchase within 14 days of receiving the product, unless the item is custom-made or personalized.
6.2 For conditions and procedures, please refer to our return policy on the website.
7. Warranty and Complaints
7.1 Malundo guarantees the quality of delivered products in accordance with applicable legal standards.
7.2 Complaints must be reported to Malundo in writing within 7 days of receiving the product.
7.3 If the complaint is justified, Malundo will replace the product or refund the purchase amount.
8. Liability
8.1 Malundo is not liable for indirect damages, consequential damages, or loss of profits.
8.2 Malundo’s maximum liability is limited to the invoice amount of the order.
9. Intellectual Property
9.1 All intellectual property rights to products, images, texts, and designs belong to Malundo or its licensors.
9.2 It is not permitted to use these without prior written consent.
10. Privacy
10.1 Malundo processes personal data in accordance with its privacy policy, as published on the website.
11. Governing Law and Disputes
11.1 These terms and conditions and any agreements are governed by Dutch law.
11.2 Disputes will be submitted exclusively to the competent court in the Netherlands.
